Lindsay Clancy trial declared a mistrial after judge makes major decision on holdout juror

It has been a week since the jury began its deliberations on the Lindsay Clancy case, and on Day 7, the judge has declared a mistrial. Both the prosecution and the defense presented their closing arguments on August 27, 2026, after which the jury deliberations began. However, the jury was not able to give a unanimous verdict.

The Lindsay Clancy trial went into a deadlock because the judge declined to remove a holdout juror who was allegedly refusing to listen to or apply the law regarding reasonable doubt as instructed. Since the jury couldn't give a unanimous verdict, the judge has declared a mistrial.

Why was the Lindsay Clancy trial declared a mistrial?

The jury in the Lindsay Clancy trial had to come to a unanimous verdict regarding whether Clancy should be held criminally responsible for the murder of her three young children. They could have either held her criminally responsible or acquitted her of the charges on the basis of severe mental illness. If they chose the latter, Clancy would have been admitted to a mental health facility rather than sent to prison.

The jury began their deliberation on August 27, 2026. On Day 6 of the deliberations, that is, September 3, 2026, the jury foreman gave Judge Sullivan a note. The note stated that out of the 12 jurors, 1 was refusing to listen to or apply the law regarding reasonable doubt as instructed. In criminal trials, jury members have to be convinced that the defendant is guilty beyond a reasonable doubt.

Thus, a jury member needs to be convinced that the defendant is guilty based on evidence and everything the trial has revealed. However, in the case of Lindsay Clancy, the rest of the jury believed that one specific juror was making decisions based on a different personal standard than the one instructed.

Thus, Judge Sullivan questioned the jurors and instructed them on the definition of reasonable doubt once again. As TMZ reported, defense attorney Kevin Reddington requested Judge Sullivan to remove the holdout juror from the case, as he was not adhering to the legal instructions. However, Judge Sullivan declined the request and decided to keep the juror on the case.

Judge Sullivan's reason behind his decision was that he believed the juror to still be fit to stay on the case. However, the jury was still split 11 to 1 over the verdict. Thus, on Day 7 of the deliberations, that is on September 4, 2026, Judge Sullivan declared a mistrial. As CNN reports, Judge Sullivan said:

"it is with a heavy heart that we report we were unable to come to a unanimous decision"

The decision was an understandably shocking one. Once declared a mistrial, a case goes on a fresh trial with a fresh jury. The defense in the case has expressed its desire to appeal the decision, and the judge has given it one hour to do so.
