Halle Berry's former husband, Olivier Martinez, has reportedly accused the Gothika actress of physically abusing their son Maceo, who is just 12.
According to People, the French actor Martinez, who is the recipient of a César Award, a highly prestigious accolade in France, has also filed for a temporary restraining order against Berry and requested sole custody of Maceo.
Court filings reviewed by People state that the Before Night Falls actor, Olivier Martinez, alleged that Halle Berry, on September 26, 2026, physically attacked their son Maceo and choked him. Martinez, in his court filings, has also reportedly claimed that Berry, who is widely known for being an advocate for women's health and the destigmatization of menopause, abused Maceo mentally as well as emotionally.
According to People, while Olivier Martinez's attorney, Patrick Baghdaserians, shared that his client's utmost and primary concern is his son Maceo's safety and well-being, Halle Berry's lawyer, Marina Beck, reportedly claimed that Martinez's court filing, including a request for sole custody and filing a temporary restraining order, lacks any basis in truth and is deceptive. Halle Berry's lawyer Beck, in a statement, said:
"To say this filing is entirely meritless and deliberately misleading would be an understatement."
The statement further noted:
"Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs."

As Halle Berry's lawyer calls his former husband Olivier Martinez's reported child abuse claims "meritless" and "misleading", the French actor's attorney, Patrick Baghdaserians, pointed out that Martinez's primary concern for his son, Maceo, is his utmost safety, health, and well-being. Baghdaserians, in a statement, said:
His client's "paramount concern is the health, welfare and the safety of the minor child, hence the action that he took in court by filing the request for a domestic violence restraining order. The second concern would be for the mother to get the appropriate help that she needs to address her issues so she can better herself, which would in turn help the minor child moving forward."
According to People, Olivier Martinez's court filing against Halle Berry reportedly claims:
"While the September 26, 2026, incident in which Petitioner choked our son is the latest incident of abuse, I contend that there have been other instances of abuse over the course of the last few years. These other incidents involve additional physical attacks against our son, as well as verbal and emotional abuse from Petitioner to me."
