How much is Blake Lively seeking in legal fees from Justin Baldoni and studio? Actress' team files litigation expenses weeks after partial court win

Blake Lively has filed a memorandum seeking to recover her legal fees stemming from the defamation lawsuit filed by Justin Baldoni and Wayfarer Studios. After settling her months-long It Ends With Us legal battle with her co-star and the film studio in May, Lively continued her bid to seek litigation costs and punitive damages under California law.

For the unversed, after Lively filed a sexual harassment complaint against Baldoni and the Wayfarer parties, the defendants filed a defamation countersuit. However, Judge Liman dismissed Baldoni's lawsuit in June last year. Under California Civil Code Section 47.1, which protects victims from retaliatory defamation lawsuits, Lively became eligible to seek legal fees, and punitive damages of up to three times. Earlier this month, the judge granted Lively's request to recover attorney fees but rejected her request for treble damages.

Weeks later, on June 30, Blake Lively's legal team filed a 15-page memorandum asking the judge to allow her to recover $8.04 million from Justin Baldoni and Wayfarer Studios.

"Lively respectfully requests the Court award her reasonable attorneys’ fees of $7,495,526.87 and costs in the amount of $539,514.01," the court document read.

Blake Lively's lawyers noted that the "significant press attention" and several other aspects in the case pushed the litigation cost.

In the memorandum filed on Monday, Lively's team lambasted Justin Baldoni and the production studio for filing the defamation countersuit against the actress.

"This gross abuse of the legal system was not meant to win in court—its aim was to retaliate against Lively by falsely branding her a liar, intimidating witnesses and the media, and discouraging others from speaking out," the filing read.

Blake Lively's team went on to accuse Wayfarer parties of targeting the actress's resources. It added:

"The Wayfarer Parties employed scorched-earth litigation tactics designed to drain Lively’s resources, including a near-daily press campaign promoting their sham lawsuit, propounding expansive and irrelevant discovery demands, obstructing discovery directed at them and affiliated third parties, and forcing Lively to seek frequent relief from the Court to reign in their abusive docket filings."

It is important to note that the filing only details Lively's request. Judge Liman has given Baldoni and the Wayfarer parties until July 13 to respond. After considering arguments from both sides, the judge will decide whether to award Lively the full amount or reduce it.

As of writing, Justin Baldoni's team has yet to comment on the latest memorandum filed by Blake Lively.
