Judge tosses out Ariana Madix’s appeal to have Rachel Leviss’ lawsuit against her dismissed

The legal battle between reality TV stars Rachel Leviss and Ariana Madix continues to draw the attention of the media and netizens, as it recently took a new turn when Madix's appeal to co-star Leviss' lawsuit against her was tossed out.

According to People, a judge in a Los Angeles court dismissed Ariana Madix's appeal in Rachel Leviss' lawsuit, citing that she only forwarded Rachel's intimate videos, which she discovered on Tom Sandoval's phone, only to her and no one else, as Madix had no intention to share the video publicly. The judge, after dismissing Madix's appeal, said:

"She failed to meet her burden of establishing that the claims alleged against her arose from constitutionally protected activity."

According to People, Rachel Leviss was briefly in a secret relationship with television personality-turned-musician Tom Sandoval, while he was in a serious relationship with Ariana Madix. Tom and Ariana were together for close to a decade before they broke it off in 2023, after learning about his secret affair with Leviss. As reviewed by People, according to the court documents:

"Madix learned of the affair when she found sexually explicit videos of Leviss on Sandoval’s cell phone, which Madix then recorded and sent to Leviss."

After Leviss' secret relationship with Sandoval was discovered, becoming publicly known with Madix calling off her years-long relationship with Tom, Rachel filed a porn lawsuit in County Superior Court in LA, against not only Ariana but also Tom, reportedly accusing them of sharing her intimate and sexually explicit videos with others. The court document stated:

"After the affair became public, Leviss filed suit against Madix for Madix’s alleged conduct in accessing, copying, and disseminating the videos."

While Leviss has also sued Sandoval in her porn lawsuit, she stated in the court documents that Madix had no permission from Tom when she got access to those intimate videos of her, which were on his phone. She also alleged that Ariana sent her intimate videos to people who work at BravoTV. Rachel Leviss stated in the court documents:

Madix "obtained these videos from Sandoval’s cell phone without his authorization" and "distributed and disseminated them to others, including but not limited to Madix herself, Leviss, and other individuals whose identities are not currently known to Leviss."
