As per TMZ's reports, the unnamed fraternity brother who was a witness spoke to the cops on November 21, 2024. He was not a defendant in Doe's civil suit. Jane Doe reported the incident to Cornell University Police on November 8, 2024.

According to TMZ, the fraternity brother told the investigators that he was a DJ at that party. He claimed that he went to his room and saw Doe with Jonathan Newell, who was apparently vomiting in a bowl or bucket. He said that Doe told him that everything was okay and she was taking care of Newell. The fraternity brother said that it felt like Doe didn't want him in the room and was thus pushing him out of the doorway.

The unnamed fraternity brother said that he then saw Doe in the room with multiple people. He claimed that she was fully clothed and was lying in bed. He said that she was speaking to the people in the room, and she didn't look intoxicated. He said that on a scale from 0 to 10, she was between 1 and 2.

He said that he asked them to leave the room so that he and his girlfriend could spend some time. The other DJ told the cop that the unnamed fraternity brother left the house with his girlfriend and a few others. Apparently, they went to McDonald's. He claimed that when he returned from the fast food joint, his room was empty.

The following morning, after he woke up, he heard several fraternity brothers discussing that they were involved in a 'consensual act' the previous night. When the interrogators asked him to describe 'consensual,' he said that Matthew Ingalls, Gillio Lopes, Winston Lee, and Newell admitted to having consensual sex with Doe.

The unnamed fraternity brother also said that Doe did not give a vibe that she was uncomfortable at the party at any point.

The unnamed fraternity brother's girlfriend was also present at the party. She spoke to the investigators on December 17, 2024. She claimed that after she returned from McDonald's, frat brothers were standing outside, curious to know what was going on inside. She said she was confused after she saw people going in and out of the room. She told the cops that she thought something was not right. She said someone from the party told the others to leave, and she saw Doe leave the party with four or five guys. However, she too claimed that Doe didn't look distressed.

According to TMZ, the unnamed girlfriend wasn't concerned about Doe that night, even though she admitted that it was scary to see Doe with so many men around. She claimed that her feelings changed when she came to know about Doe's account. She claimed that she heard drugs were involved. She also said that she felt guilty for not aiding Doe.

However, she told the cops that there was no way of confirming that something went wrong, as Doe and the men looked 'very calm' and said it seemed consensual, as no one looked distressed.
