Kanye West and Ty Dolla $ign have reportedly been facing a copyright infringement lawsuit over their track 530 from the Vultures 2 album, due to the allegedly unauthorized use of a sample from Los Angeles-based artist Swsh’s 2018 acoustic track, Break the Fall.

According to a Billboard Pro report, after Vultures 2 was dropped in August 2024, Swsh publicly noted that they had not cleared the sample and expressed no objection. His team subsequently reached out to Kanye West to address the uncleared sample issue, but the matter was not settled.

The track was later re-released on an official streaming version of Donda 2 that dropped in April 2025. This prompted Swsh and their London-based record label, Future Bounce, to file the lawsuit, seeking financial damages in the form of lost royalties from the unauthorized usage across both projects.

Kanye West and Ty Dolla $ign have made headlines after artist Olivia Anne Quillin, also known as Swsh, along with their label Future Bounce, filed a copyright infringement lawsuit against them over the allegedly unauthorized sample of Swsh’s 2018 track, Break the Fall, in the song 530 from Vultures 2.

According to a Billboard Pro report, the lawsuit reads:

“By exploiting Swsh’s creative output without credit or compensation, defendants usurped the commercial and artistic value of their sound recording and underlying musical composition while misrepresenting its authorship to the public”

It continued:

“This unauthorized use deprived plaintiffs of rightful sales and licensing revenue, diminished the value of their work and interfered with their ability to control how that work is experienced and perceived.”

Swsh publicly called out Kanye West and Ty Dolla $ign in August 2024 for using a sample of Break the Fall (Acoustic) on 530 without the artist’s permission. They posted about it on their Instagram story and wrote:

“When people keep thanking you for clearing the sample for Kanye but you literally found out this morning lol. Much love tho [shrug emoji] [heart hands emoji].”

According to their post, fans thanked them for clearing the sample for West, but her comment had a lighthearted and nonaggressive tone. The Instagram post preceded Swsh’s team reaching out to Kanye West’s camp for a resolution, which reportedly failed.

Vultures 2 also featured samples from artists like Leon Bridges, Led Zeppelin, Portishead, Isabella Papile, and Alice Merton.

A Billboard report stated that Portishead’s Geoff Barrow called out West for the use of his track Machine Gun (2008) in Field Trip. Reportedly, the drum pattern was heavily used and became a major point of controversy.

Leon Bridges’ River is also used in the Vultures track of the same name. A representative for Bridges described the sampling as "a surprise" shortly after the album was released. They noted that Bridges never recorded an original song for or with Kanye West.

German-Irish artist Alice Merton filed a copyright infringement lawsuit against West, reportedly in March 2025, over an unauthorized sample of her 2022 track, "Blindside," used in the track "Gun to My Head." The track featured Ty Dolla $ign and Kid Cudi.

According to the reports, Merton denied the request from the singer’s team to clear the sample, citing his antisemitic and racist remarks as the reason for her refusal.
