Law & Order: Special Victims Unit Season 28 premiere recap: Captain Olivia Benson investigates a sexual assault case

According to Variety, the season opener episode begins with Emily, a young woman who finds herself in a subway car. She is dizzy and disoriented. Emily believes she was sexually assaulted by a group of three men. She passed out after consuming too much alcohol. At the hospital, she tries to blame herself and says that she doesn't remember. However, Captain Benson encourages her to speak the truth.
At the NYPD station, the detectives argue whether someone with Emily's alcohol content can give consent. Detective Jake Griffin adds that no one can give consent when they are that drunk. However, Detective Bruno seems to disagree. Captain Benson cuts short their discussion and explains that the law says the victim has to be helpless or given an intoxicating substance without consent. Griffin calls the law garbage, and Benson agrees.
Later, Detective Griffin and Captain Curry interrogate the three suspects. Among them is Scott, who works at a tech company. Scott said that it was consensual, and it happened in Josh's mother's place. Other suspects were Josh and Daniel. When Detective Griffin asked whether Emily gave consent, Scott replied that she didn't say no. Elsewhere, Sgt. Tutuola questions Daniel, and Sgt. Rollins and Detective Bruno interrogate Josh, a lab technician. It turns out Josh was friend-zoned by Emily. Josh's mother shows Benson footage of Scott and Daniel telling Josh not to miss an opportunity, as they say Emily won't remember a single thing.
Law & Order: Special Victims Unit Season 28 Episode 1 recap: A rift between Carisi and Benson

The case moves to the court where ADA Carisi is joined by ADA Aidan Hawkins, a fresh Harvard law graduate. Gwen Sharpe, a veteran jury consultant, also appears in the courtroom and tells Benson,
"You have faith in the system and I hope you're right. I just wouldn't have gone to trial with this."
At the trial, defense attorney Andrea Vargas tries to grill Emily about consent. Emily breaks down. Later, Vargas offers Carisi a strange deal. Carisi wants to take it and urges Benson to do the same. However, Benson doesn't agree, and Hawkins supports her decision. This makes Carisi angry, and the viewers can sense a rift between the Captain and ADA. The case goes on to a retrial.
Later, Benson and Sharpe talk about the injustice that women face. Sharpe advises Benson to fight differently. Benson arrests Josh's mother on charges of tampering with evidence and conspiracy to commit rape to place Josh in a difficult position. The plan works, and Josh agrees to testify in exchange for a lesser charge and the release of his mother. The rift between Carisi and Benson grows wider.
Law & Order: Special Victims Unit Season 28 Episode 1 recap: Does Emily get justice?

At the retrial, Josh testifies. He reveals that on that night, Emily was lying in bed and she constantly asked for her phone to call an Uber. It turns out the suspects had her phone. When Emily passed out, Scott and Daniel entered the room, and three men r***d her. Josh confessed that Emily had no consciousness. Scott and Daniel were found guilty of rape in the first degree. While Benson was exiting the courtroom, she saw Carisi and felt guilty.
